Senate Bill 21-062 BILL SUMMARY
This bill prohibits a peace officer from arresting a person based “solely on the alleged commission” of a crime. If the Peace Officer believes a crime has been committed HE THEN BECOMES A REFEREE AND ISSUES A SUMMONS BECAUSE the Officer cannot arrest – he/she must issue a summons[1] [2] if the crime is a class 4, 5, or 6 Felony, a Level 3 or 4 Drug Felony, or a Misdemeanor Offense.
